Last Will and Testament
Fla. Stat. § 732.502Create a simple Florida will to direct distribution of your estate and name an executor.
A Last Will and Testament directs how your property is distributed after your death and names a personal representative (executor) to administer your estate.
Florida execution requirements (§ 732.502):
- The testator must sign at the end of the will (or direct another to sign in their presence);
- The signing must occur in the presence of two witnesses;
- The two witnesses must each sign in the presence of the testator and each other;
- Witnesses should not be beneficiaries under the will.
A self-proving affidavit (signed before a notary) allows the will to be admitted to probate without the witnesses appearing in court.
